Fair Value, Revalued: Rebuilding the Valuation Process for CIRP
The latest issue of the AIPE Newsletter brings together key developments across India’s insolvency and restructuring ecosystem from 16–31 August 2026.
This fortnight saw renewed judicial focus on process integrity, creditor rights, personal guarantor insolvency, statutory appellate remedies, employee entitlements and guarantee-based financial debt.
Highlights from Issue 31
Personal Guarantor Insolvency
The Subhash Chandra repayment plan remains a significant development. While a ₹6.25 crore plan against approximately ₹22,006.57 crore of admitted claims was initially approved, a five-member NCLT Bench subsequently stayed the order and directed a fresh hearing.
Supreme Court Watch
Key developments include the Supreme Court’s observations on statutory appellate remedies, its notice in the Equinox India Developments matter, and its decision not to interfere with the NCLAT ruling concerning PF, gratuity and pension dues of Jet Airways workmen.
NCLAT Developments
The issue covers CoC composition and voting rights, Section 7 admission-stage requirements, homebuyers’ election of remedies and procedural appeals.
NCLT Developments
Key topics include financial debt and guarantees, operational debt and pre-existing disputes, resolution plans and CoC commercial wisdom, and avoidance proceedings.
